Terms and Conditions for Les Quatre Chenes

  • Properties known as Les Quatre Chenes – Starling Lodge, QuatreChenes, Mulberry Lodge, 630 Route du Meriller, Le Fleix, 24130, France, Siret  97749111700015 are offered for rental subject to confirmation by Les Quatre Chenes and Steven Adams and Helen Adams(the owners) to the hirer/tenant (guest).
  • Reservation requests for the properties can be made by email to the owner. Once a booking request is confirmed as having been received by the owners, the guest must complete and sign the booking form and acceptance of the terms and conditions (the contract)and return it with payment of the initial non-refundable deposit of 25% (50% July/August) of the total rent due for the guest’s stay in order to reserve the property. After receiving the contract and the deposit, the owners will send confirmation to the guest confirming the reservation of the property. This is the formal acceptance of the reservation.
  • The balance of the total rental amount is required eight weeks before arrival, or any shorter period stipulated by the owners if a reservation is made less than eight weeks prior to the arrival date. The owners reserve the right to give written notice –including by email, of any balances not received in full by the date required to the guest, the reservation of the gite is cancelled. Owners will not be required to refund the deposit.
  • In the event of cancellation, the owners will attempt to re-let the property. If successful, the deposit will be refunded to the guest.
  • Bookings made within eight weeks of the start of rental period require full payment at the time of booking.
  • It is strongly advised that the guest take out a comprehensive travel insurance policy (including cancellation insurance) and have full coverage for personal effects and civil liability as these are not covered by the owners insurance. The cancellation of a reservation by the guest is only valid upon written confirmation from the owners.
  • Cancellation by the guest must be formally made in writing (or email), except in the event of non-payment of the balance or total rental amount in accordance with clause 3 (above),which will be considered a formal cancellation by the guest and written notice will not be required.
  • In the unlikely event the owners are forced to cancel the booking due to serious illness or major changes due to matters beyond their control, the owners will notify the guest as soon as possible and endeavour to offer suitable alternative accommodation. If this is not possible, the owners will give the guest a full refund of all monies paid and have no further liability.
  • The owners shall not be legally liable, jointly or individually, for any compensation or to refund any deposit paid if the owners are prevented from carrying out responsibilities under this contract as a result of events beyond their control. This means an event that the owners could not, even with due diligence, expect or avoid, including a natural disaster; global health; act of terrorism; malicious damage; fire; flood; snow or storm, comply with any law or governmental order, rule, regulation or directive; insolvency or bankruptcy of the owner or any other circumstances affecting the supply of goods or services.
  • A security deposit of 500 Euros is payable on the day of arrival. This is required in the event of damage to the property or its contents; however the sum reserved in this clause does not limit the guests liability to the owners. The security deposit held by the owners will be applied against cleaning, repair or replacement caused by means other than normal wear and tear whilst renting the gite. Following a satisfactory verification of the inventory and the inspection, the security deposit will be refunded back to the guest within 10 working days.
  • The rental period of the gite begins at a time agreed between the guest and the owners – generally at5.00 pm on the first day ( in the event of an expected arrival after 8,00 pm, the guest must inform the owners beforehand by telephone) and ends at 10.00 am on the last day of the guest’s rental period (departure time).
  • The owners will not be required to offer accommodation before the stated time and the guest will notbe permitted to remain in occupation of the gite (unless previously agreed with the owners).
  • Should the rental period be shortened by the guest for any reason, the total rental amount will not change and there will be no refund to the guest.
  • The maximum number to reside in the properties as follows: Starling Lodge – 10 people, Quatre Chenes - 8 people, Mulberry Lodge – 2 people
  • The maximum number of people per gite includes adults and children (babies will not be included in this number). Travel cots are available if required, please advise at time of booking.
  • The property’s facilities are for use of the guest group only. Please speak to the owners if you would like to invite guests to the property.
  • The guest is responsible for all members of the group, including any agreed on visitors, using thefacilities of the property. The guest agrees to be considerate and to take careof the property and to leave it in the same condition as at the start of the rental period.
  • The property is cleaned and checked before each rental. The owners also reserve the right to make a deduction from the security deposit to cover any additional cleaning costs if the guest leaves the property in an unacceptable state or damage is discovered.
  • Please note that the above charges do not in any way invalidate the damages clause (clause 10) and do not limit the guest’s liability to the owners for damage to property, fixtures or fittings.
  • The guest undertakes not to act in such a way as disturb neighbouring properties. The owners reserve the right to require any guest or party member deemed to be acting unreasonably or unlawfully to vacate the gite immediately.
  • Well behaved pets are welcome but are the complete responsibility of the guest. The owners accept no liability for any loss or injury suffered or caused to others. Please note the boundaries are not fully secure.
  • Any damage inside the property, gardens or pool area caused by pets will result in loss of part/all of the security damage
  • The guest must report to the owner, as soon as possible, any defect in the property, failure of machinery or appliances in the property, garden or pool, and arrangements for repair and or replacement will be taken as soon as possible. Complaints regarding any faulty or non-functional aspect of the gite or their facilities cannot be accepted on or after the guest’s departure.
  • The guest agrees to allow reasonable access to the gite by the owners or any maintenance staff during the rental period for the purpose of repair and maintenance.
  • The guests shall use the swimming pool and any facilities provided at the property, including surrounding area, entirely at their own risk. The owners shall not be liable for any loss, damage, injury or death.
  • Use of the properties and any amenities is entirely at the guest’s own risk. Guest’s personal effects(including cars) left in or around the property are done so entirely at their own risk and no liability will be accepted by the owners for any loss or damage.
  • Bed linen and bath towels (NOT POOL TOWELS) are provided for the number of people who have registered to stay at the property during the rental period ( a supplement will be imposed for additional bed linen). Nothing to be removed from the gite. In the event of discrepancy in items provided between arriving and leaving, the cost of replacing the items will be deducted from the security deposit.
  • The swimming pool is open from May 1st until 30th September (negotiable weather dependant). The swimming pool can be used between the hours of 10.00 am and8.00 pm each day. Weather permitting, we will endeavour to open the pool beforeMay and close after September. The pool is regularly maintained, but if unusual weather changes occur, this may affect the chemical balance. If there are any issues with the water clarity, please contact us. A safety notice and use of pool rules and regulations can be found in the information pack. Please ensure that safety notices are read and understood by all guests in the group.
  • No glass, bottles or china to be used around the pool. Plastic glasses are provided. If glass or china should fall into the pool, it may need to be drained, cleaned and refilled at great expense. It may take several days. The security deposit will be lost.
  • The owners reserve the right to close the pool or restrict the hours of swimming use for any period of time in circumstances which we deem necessary in the interest of health and security.
  • The owners are not responsible for any loss or inconvenience that may be suffered due to unforeseen breakdown of pumping/filtration systems or any other equipment used in the pool.
  • Theguest is responsible for ensuring that none of the children in their party areleft unattended at any time whilst the pool is open.
  • The swimming pool is fitted with a hard cover in accordance with safety rules. The cover will be removed at 7.30 when necessary for cleaning. The robot takes 2.5 hours to clean. No swimming is allowed whilst the pool robot is running.
  • Theguest is responsible for ensuring children and adults respect the pool, poolfurniture and related equipment AT ALL TIMES.
  • The owners will make every reasonable effort to ensure the safety of the guests, but no liability can be attached to the owners for unsupervised children or adults harmed or injured asa result of swimming. The guest is responsible for ensuring the pool users are properly supervised at all times.
  • The owners will not be liable for any injury, loss or personal damage caused as a result of the use ofany children’s equipment, toys, balls, BBQ or other equipment left on the property for the use of the guests during the rental period.
  • It is forbidden to smoke in the gite or around the swimming pool. In other areas, please dispose of cigarette butts in a clean and responsible manner and put them in a bin.
  • The guests at the property shall not do or permit anything to be done which may result in the nullity or cancellation of the insurance of the property or increase the premium. The right to use the property may be revoked with immediate effect by the owners prior to the end of the rental period by the owners notifying the guests in the event of material breach by the guest of the terms of this agreement.
  • The owners will not be liable to the guest for any fault or temporary stoppage in the supply of utilities to the property, nor in respect of any equipment, plant, machinery appliances in the property, garden or pool. Any loss, damage, injury or death resulting from adverse weather conditions, fire, riot, strike, war or other matters beyond the control of the owners.
  • Any loss, damage or inconvenience caused or suffered by the guest if the property is destroyed or substantially damaged before the start of the rental period, the owners will refund within two working weeks of notifying the guest, all sums previously paid to the owners for the rental period. In case of cancellation or modification of the reservation due to force majeure (which includes adverse weather conditions, fire, riots, strikes, wars) or other events beyond the control of the owners, the owners cannot accept any liability.
  • The owners reserve the right to make changes to the interior and or exterior of the properties between the time of acceptance of the guest’s reservation and the start date of the rental period.
  • From time to time the owners with to publish feedback from a guest on their website and advertisements. Thus, unless otherwise requested, the owners will assume no objection to this.
  • Whilst every effort is made to ensure the description of nearby properties and facilities is accurate as possible, the owners cannot accept any responsibility for any changes beyond the owners control.
  • This contract was freely negotiated and shall be deemed the entire agreement between the owners and the guest and each member of the invited party. Only changes or modifications put in writing, attached, dated and signed by the guest and owners will be accepted. No person who is not a party to this agreement shall have any right sunder or in connection with it.
  • A tourist tax of 1 euro per adult per night, as charged by the Prefecture de Dordogne, will be added to the balance of the total rental amount, payable ten weeks before arrival date.
  • Itis absolutely forbidden to charge electric cars using our network; we have arate limit that breaks our circuits even on a slow charge.
  • This contract is governed byFrench law in all its aspects, including formation and interpretation, and is deemed to have been concluded in France. Any proceeding arising out of or in connection with this contract may be brought exclusively in any court of competent jurisdiction in France and the parties to the contract hereby waive and revoke the right to initiate or continue any proceeding in any other courtor jurisdiction.
  • If any provision or part of the contract is or becomes invalid, illegal or unenforceable, it must be modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible,, the relevant provision or part thereof shall be deemed deleted. Any modification or deletion of any partial provision under this clause shall not affect the validity and enforceability of any other part of the contract.
  • Please note that these conditions will form part of the confirmation letter from theowners and that the guest is deemed to have read and accepted these terms and conditions once the deposit has been paid to the owners.
